Description
The module seeks to examine the legal arrangements for identifying and protecting the different interests in land, the legal duties and obligations of those engaged in the property sector, the means of controlling development, the scope for the state to acquire private land for public use through compulsion and the mechanisms for promoting major infrastructure in different jurisdictional contexts, in particular in the UK and the USA.
It will include brief coverage of contract law and tort, a knowledge of both of which is important in the day-to-day work of those engaged in the property sector.
Students will be introduced to such issues as the various interests in land and property (freehold and leasehold, legal and equitable etc) and the implications for its use arising from restrictive covenants, easements and so on. The means by which property can be transferred and interests protected through registration will be explained.
The examination of land use planning controls will be supplemented by consideration of the role of compulsory purchase (eminent domain) and the basis for compensation. Finally, the role of statutory mechanisms for the promotion of major infrastructure schemes such as airport expansions and new railways will be considered.
